“RUDE! Developments in the Judicial and Administrative Regulation of Lawyers’ Civility.”
Lecture: 40 minutes followed by a 20 minute question & answer period.
Topic Overview:
The program will examine the relevant rules and decisions through the lens of Prof. Randal Graham’s regulatory model of legal ethics, developed in “Legal Ethics: Theories, Cases, and Professional Regulation” (3rd ed, Emond Publications, 2014). The objectives are to examine: (1) The rules found the Federation of Law Societies Model Rules of Professional Conduct, (2) Ontario’s Rules of Professional Conduct, (3) the Supreme Court’s jurisprudence on civility regulation (most notably the Court’s 2018 decision in Groia.)
The content will be grounded in proceedings brought under s. 33 of the Law Society Act with respect to “professional misconduct and conduct unbecoming”, a discussion of appropriate penalties under s. 35, and discussions of the appropriate use of the Court’s “Contempt of Court” power to regulate instances of alleged incivility that take place in the courtroom.
